Terms of Service
Welcome to Staykay! By accessing or using our website and services, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully. If you do not agree with any part of these terms, you must not use our services.
1. Definitions
- •"Platform" refers to the Staykay website and any related services.
- •"User" refers to anyone who accesses or uses the Platform.
- •"Host" refers to individuals or entities offering accommodations on the Platform.
- •"Guest" refers to individuals or entities booking accommodations through the Platform.
- •"Content" refers to any text, images, or other material provided by Users, Hosts, or Staykay on the Platform.
2. Use of the Platform
- •Eligibility: You must be at least 18 years old to use our Platform.
- •Account Registration: Users must create an account to access certain features of the Platform. You agree to provide accurate, current, and complete information during the registration process and update such information to keep it accurate, current, and complete.
- •Account Security: You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.
3. Host Obligations
By listing on Staykay, all Hosts shall agree to the following:
- •Accurate Listings: Provide truthful and complete details about the property, including location, amenities, rules, and photos.
- •Availability Management: Keep calendars updated and promptly block unavailable dates. Use the Airbnb or other booking platform calendar import to prevent double bookings.
- •Compliance with Law: Ensure the property complies with Philippine laws, local ordinances, and building regulations (including safety, zoning, and business permits if required).
- •Host a Stay Submission: Hosts may list properties via the 'Host a Stay' button. All submissions will be reviewed and approved by Staykay before going live.
- •Fair Treatment of Guests: Honor confirmed bookings and provide the accommodation as described. Any cancellation by the host must be for valid reasons and communicated immediately.
- •No Off-Platform Transactions: Hosts are strictly prohibited from inviting Staykay platform guests to transact externally from the platform. Any violation may result in listing removal or permanent banning.
- •Data Protection: Protect guest personal information and use it solely for booking-related purposes, in compliance with the Data Privacy Act of 2012.
- •Maintenance & Safety: Ensure the property is safe, clean, and well-maintained for guests.
- •Taxes & Reporting: Hosts are responsible for declaring and paying any applicable taxes related to their earnings from Staykay.
4. Guest Obligations
By booking on Staykay, all Guests shall agree to the following:
- •Accurate Information: Provide truthful personal details when booking.
- •Respect Property Rules: Follow all house rules set by the host and respect property facilities.
- •No Off-Platform Transactions: Guests are prohibited from soliciting or completing payments outside Staykay.
- •Check-in Verification: Verify check-in through the platform upon arrival.
- •Responsible Stay: Treat the host's property with respect, care, and avoid any damage or misconduct.
5. Reservations and Payments
- •Platform Payments: All payments must be made directly through the Third-Party payment gateway platform Xendit Philippines Inc. Staykay reserves the right to review and validate submitted proof of payments.
- •Booking Confirmation: By making a booking, you agree to pay all charges associated with the booking, including applicable taxes and fees. A booking is only confirmed once accepted by the host.
- •Payment Processing: Payments are securely processed through Staykay's third-party gateway called Xendit Philippines Inc., which is subject to different terms of service and privacy policies. Guests and Hosts alike should review them, as Staykay is not responsible or liable for issues arising from policies of such Third-Party Services. By completing a booking, you authorize Staykay and Xendit to process your payment. Accepted methods: credit cards, debit cards, e-wallets, and direct bank transfers.
- •Fees and Policies: Service fees and applicable charges are displayed at checkout before payment.
- •Host Payouts: Hosts may request payouts through the Staykay platform. Payouts are processed within the same day or up to two (2) business days, depending on the payout method (GCash, BDO, BPI).
- •Cancellations and Refunds: All bookings are final once accepted by the host. Guests cannot cancel their bookings after host acceptance. Refunds are only granted if the host or Staykay cancels the booking. Refund timelines: Credit Cards, E-wallets, Bank Transfers → 5–7 business days.
- •Check-in Verification: Guests must verify check-in through the platform within 12 hours of arrival. Once verified, payments will be released to the host. Staykay is not liable for refunds after check-in verification unless cancelled by host or Staykay.
- •Off-Platform Payments: Staykay is not liable for and will not facilitate refunds for payments made directly to hosts outside the platform.
- •Force Majeure: Staykay shall not be held liable for cancellations caused by events beyond our control (e.g., natural disasters, government restrictions, health emergencies). In such cases, refunds will follow the same policy as above.
- •Dispute Resolution: Disputes between guests and hosts must be raised through Staykay support within 12 hours of the incident. Staykay's decision will be final.
- •Governing Law: These Terms are governed by the laws of the Republic of the Philippines.
6. User Verification
- •ID for Verification: Guests must submit an ID for verification. This ID will be deleted 24 hours after check-out. Any other IDs requested by the Host for accommodation processes are not the responsibility of Staykay.
7. User Conduct
Prohibited Activities: Users agree not to:
- •Use the Platform for any illegal or unauthorized purpose.
- •Post false, misleading, or fraudulent information.
- •Infringe upon the rights of others, including intellectual property rights.
- •Interfere with the operation of the Platform or the enjoyment of the Platform by others.
8. Content and Intellectual Property
- •User Content: Users retain ownership of the content they post on the Platform. However, by posting content, you grant Staykay a worldwide, non-exclusive, royalty-free license to use, copy, modify, and distribute your content in connection with the Platform.
- •Host Content for Advertising: By listing your property on Staykay, you agree that Staykay may use your property listing, including photos, descriptions, and reviews, for advertising and promotional materials across various platforms and media channels to promote Staykay's services.
- •Staykay Content: All content provided by Staykay, including text, graphics, logos, and software, is the property of Staykay and protected by intellectual property laws. You agree not to reproduce, distribute, or create derivative works from any Staykay content without express written permission.
9. Platform Rules
Staykay reserves the right to:
- •Modify or terminate services at any time
- •Remove content that violates our policies
- •Suspend or terminate accounts for policy violations
10. Disclaimers and Limitations of Liability
- •No Warranty: The Platform is provided on an "as is" and "as available" basis. Staykay makes no warranties, express or implied, regarding the Platform's operation or the information, content, or materials included.
- •Limitation of Liability: To the fullest extent permitted by law, Staykay shall not be liable for any damages of any kind arising from the use of the Platform, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless Staykay, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Platform or violation of these Terms.
12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Philippines. Any disputes arising out of or in connection with these Terms shall be resolved in the courts of Manila.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. We will notify you of any significant changes by posting the new terms on our website and updating the 'Last Updated' date. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
